Under the Texas Penal Code, there are five types of felonies, whose punishment range is as follows:

1. Capital- either life in state prison, or the death penalty.

2. 1st degree- 5 to 99 years in prison, and a fine up to $10,000.

3. 2nd degree- 2 to 20 years in prison, and a fine up to $10,000.

4. 3rd degree- 2 to 10 years in prison, and a fine up to $10,000.

5. State jail- 180 days to 2 years in state jail, and a fine up to $10,000.
