Driving While Intoxicated vs. Driving Under the Influence

While Driving Under the Influence (DUI) and Driving While Intoxicated (DWI) laws are often interchangeable in most states, they have two different meanings in Texas. Our laws strictly prohibit residents under the age of 21 from consuming alcoholic beverages of any kind. All minors accused of disobeying the law by driving while intoxicated face severe DUI charges. Sufficient proof of DUI includes catching a minor with "detectable" traces of alcohol in their systems at any given time. On the other hand, if you are over the age of 21 and you have been accused of committing the same crime, you can't be charged with DUI according to Texas law. Residents of age to drink are instead charged with DWI if they are ever accused of intoxicated driving. The penalties for both are serious.

Considered to be a class "C" misdemeanor in the state of Texas, there is a penalty up to $500 attached to every DUI charge. Conviction of DUI could result in your driver's license being revoked, a mandatory community service sentence of up to 40 hours, and/or required attendance of an alcohol education course. A DWI or Boating While Intoxicated (BWI) charge, which is a class "B" misdemeanor, could lead to a six-month jail sentence or a $2,000 fine.

Admissible evidence for charging you with driving while intoxicated or boating while intoxicated include:

  • Loss of full cognitive (mental) function, including your ability to think clearly
  • Abnormal physical dysfunction, including your ability to walk on a straight path
  • A blood alcohol concentration (BAC) level exceeding .08
