Moving Violations

Moving Violations Attorney in Dallas

Helping You Retain Your Driving Privileges

A moving violation is when a driver has violated traffic laws while the vehicle is in motion. In Texas, moving violations are penalized according to a point system. This means that for every traffic ticket that a person gets, he/she earns a certain number of points that are used to assess the amount of fines and justify the suspension of his/her driver's license.

If you have committed a moving violation in Dallas, make sure to seek help from the experienced traffic ticket attorneys at Berloff & Newton, P.C. Our firm handles a wide range of moving violations including:

  • Speeding tickets
  • Red lights
  • Stop signs
  • Accident tickets

How The Point System Works

If you have too many moving violations in one year, your license can be suspended. If you were speeding 10% over the posted speed limit, you will receive a two-point violation. If your speed was 15mph over the speed limit, you will receive a three-point violation. If you caused a wreck as a result of the moving violation, your points will increase to three points. You can only get five points in a calendar year or your license can be suspended.

You should keep in mind that if you just pay off your ticket, you can face more surcharges and increased insurance rates. Points will remain on your driver record for a period of three years from conviction date.

If you accumulate six or more points on your record during a three-year period as a result of traffic tickets, the Texas Department of Public Safety (DPS) will assess a surcharge. This surcharge will then be assessed annually. If you continue to reflect six or more points during a three-year period, you will have to pay a $100 surcharge for the next six points and $25 for each additional point.
